Ahilibanfield, HLN crime and justice host: Good evening everyone, this is ashilibanfield, this is "crime and justice ".
"Thank you for joining us tonight.
The beautiful Arizona teacher was caught with a red burning detail.
Derailed and cheated her husband, but police said it was sex with minors and released more wet information about the sixth-grade students she allegedly was.
Kyle Perrier is covering the story.
Kyle, the parents of the boys are very angry and they are suing now and they are not just suing a little bit.
Crime and Justice producer Kyle Perrier: Yes, just when we thought the story would never find x againrated, it does.
There are some details in this brand new document that we can't even report, but the biggest problem is what the school knows and when.
Okay, Kyle, thank you. we'll look into it soon.
Also tonight, the wife of a police officer was accused of shooting her husband and told police within minutes that he had committed suicide.
Bernice Man is tracking the story.
There are some very different accounts on it, aren't they?
Crime and Justice Producer: Yes, Ashley.
We got a 911 call from the wife who made that tape.
You tell me what you think is going on and we will listen.
Murder or suicide?
BANFIELD: I always like the 911 call because that's the case now, so you really have to evaluate it yourself.
Thank you, Bernice.
In addition, this shocking new charge could undermine the divorce of celebrities in the past two years.
Angelina Jolie described Brad Pitt as some kind of lifeless father.
Is it really possible for Justin Freiman?
Old Justin Freman
CNN Correspondent: Angelina said Brad Pitt has not paid support since he separated a year and a half ago, but today, his lawyers, they fired him, they said he gave her millions.
We will have more in this battle.
BANFIELD: Yes, there's a small word called meaningful child support, and I don't know what makes sense to you or me, but I bet it's different for them.
We will discuss this later.
Thank you, Justin.
In addition, animals, animals with auxiliary animals, how a group of cattle help a suspicious car thief.
You really have to look at this on the helicopter video and see how it goes down.
We will show it to you in full.
Also later, it was shocking to search for new details of Molly tibatters, a college student who went missing after running.
Tonight, we will talk to her father because the local paint farmer who is talking to the police refuses to accept a lie detector.
We will find out why.
First of all, what I want to say is the good year of Arizona, Brittany Samora, a married secondary school teacher, is accused of hooking up with her sixth-grade students.
Tonight, we are learning how she turned from a student to a victim.
We are learning who else is in trouble for allegedly letting this happen.
Because according to some brand new documents, some of the staff at Las Brisas college may just know
Relationship between minors in Zamora
It is reported that she openly flirted with the victim during recess. Yes, recess.
You see, flirting is a typical middle school experience, but not when an adult teacher is a flirt.
In these new documents that we get, we say this interaction takes place in school time and school activities.
They have sex inside and outside the campus.
In the end, the principal even heard rumors about Ms. Li.
Zamora is dating her students.
There is also said to be some conclusive evidence after a bag of bare bones
It is said that someone found her in her classroom.
But, for the lady, it requires a different set of information
Zamora is in trouble, text messages found by the victim's parents on his phone, saying, quote, I'll give you whatever you want, baby. Mrs.
Samora is now guilty of numerous allegations of child molesting and sexual behavior.
Until the trial began, she was still in prison because no bonds had been published so far.
But at the same time, it may be that her old school paid a price of $2.
Loss of 5 million
That's what the parents behind the lawsuit told CNN affiliate KTVK, or at least threatened the lawsuit.
By the way, their voices have been changed. (
Start Video Editing)
I want her to spend the rest of her life in prison.
I want the school to be responsible for what they do, to change the rules, until this will never happen to another parent's child. (END VIDEO CLIP)
BANFIELD: I was on the phone with Tom Perumean, an investigative journalist.
In addition, Russell Richelsoph is a lawyer for parents of minors.
Then defense lawyer Eric Weitz was in the studio with me. [18:05:13]
Tom Perumean, let me start with this.
We 've been getting dribs and drabs since the story was broken, a lot of information about it, but I'm shocked to find out today that Brittany Samora is still cooling the heels in prison.
I think the bond price is around $250,000.
It is a big sum of money for a teacher or teacher and her husband.
We know if this is too much for them or if her husband posted too much emotion? Any idea?
Investigative reporter tom perumean: Well, let's remember that $250,000 of bonds can be issued for $ 10%, $25,000.
Does the abandoned husband want to come up with the money, and I think that's certainly a big problem there?
That's why she kept turning her wheels in prison.
No one came up with the 25 grand to let her out.
BANFIELD: You see, 25 grand is also a lot of money, especially for teachers.
And if they really want to do that, there's the teacher and her husband.
Tom, tell me about the latest news, because if our audience doesn't think it's wet and dirty before, then something new will be disgusting.
Oh, yes.
Well, that's the word.
In the movie "Good Guy", Robert De Niro wrote hundreds of pages of phone taps, transcripts and told Ray Liota that I told about talking on the phone
You know, we can update now because of these text messages between the ladies
Zamora and her victims are included in the evidence, which will mainly bury her.
It may bury the Las Brisas College and the free primary school district.
Her ropes, what she's talking about, what she's describing, what she wants to do to this boy, even this boy-
Some of the boy's reaction, you know, is that we're working on the "r" rating and, you know, we certainly can't talk about it in public.
Another revelation is that not only did the principal of the Las brissas college know Brittany Samora, who was the one who recruited her to the Las brissas college, when he heard suspicious activity, he turned his cheek on the other side.
Now, in the proceedings, he is accused of not taking action to protect the students and reporting on Zamora.
He was charged with violating state regulations, and the Las Brisas College and Free School District cleverly-
It seems that Zamora is allowed to continue as a predator.
In the plaintiff's proceedings, they were even accused of violating Chapter 9 of the federal statute, in which Zamora's activities were considered discrimination.
Banfield: they are very interested in this.
I really want to, because as far as I know, I will correct me if I am wrong, and it is a threat lawsuit.
This is not a lawsuit.
There is a difference.
One of them is very scary, you have to give the answer right away, and the other is that if you don't do anything with us, solve it with us, we're going to file it.
So this time, it's probably all closed-door discussions.
I do want to do one thing, though.
For anyone who hasn't seen this before, I 'd like to take you back a bit, and I 'd like to show you some of the raw information that this child's parents have removed from his phone.
The way they do this is that they have an app that they are looking for keywords.
Boy, have they found those keywords?
So they say to their kids, you text her now, you make it sound like you and your parents are not on your shoulders, and we want to see what text she sent back.
That's the charge, you know, so far, in the criminal complaint, not in the proceedings, which is from the criminal complaint.
The police said that's what they got from their parents. The boy says --
Once again, mom and dad look on his shoulder, so it's amazing that he and his so-called girlfriend are so frank, I think "f" you're such a bad kid, that's not enough time for me.
The reply allegedly received from the wife
His sixth grade teacher, I know, baby, I want you every day, no time limit.
She also allegedly said that if I could quit my job and "f" you all day, I would.
The boy said, I need you to give me more blanks, and you have to fill in the blanks because I can't say on TV that it is said to be the lady
I'll give you whatever you want, baby.
So that's what we know.
What I want to read is something we don't know.
This is obviously from the back. it notes.
I will ask the control room if they can fill the screen for me.
Because after a bag
Its notes were apparently discovered by the staff, probably later, some of them said something, for example, you made me want to burn. F.
, You should know, if you don't do that, check the city dictionary and what is "". F.
That means, but here's a clue. [18:10:05]
Another note says your husband is going crazy.
On the other note it says your cookies call me to blink and blink.
Again, the Urban Dictionary, the definition of "cookie" is a woman's vagina.
The last point, perhaps the most telling question, is when are we going to smash it?
I don't think I need a city dictionary to figure out what that really means.
If I can ask Russell Richelsoph to come, he is a lawyer for the parents of the victims.
Russell, can you hear me?
Russell richelsoph, lawyer for Minor's parents: I can hear you.
BANFIELD: OK.
So, I just got dizzy with these things.
It looks like you and your client are able to get a lot of material from the police as these things don't show up in criminal proceedings.
How did you get this material?
I just touched the tip of the iceberg here.
RICHELSOPH: this was shared with us by the district attorney's office in Maricopa.
This is the information we can get through a public record request.
Because of this, they have just given us the material in order to save us time to submit a public record request.
Banfield: Well, that's--
I mean, very persuasive stuff, especially because we don't see it in criminal proceedings.
If the prosecutor had these things, it would have been very bad for Hillary. Zamora.
In the proceedings you intend to bring, there are other facts in the material.
You want to sue for about $2. 5 million.
Right?
RICHELSOPH: That's right.
Banfield: can you tell me why you are suing the director and the District?
I think it's Lady.
Zamora too, please correct me if I am wrong.
What are the specific reasons you want to sue them?
RICHELSOPH: Well, are you saying what action is in charge of this area?
BANFIELD: Yes.
RICHELSOPH: it's important that we all know what Brittany Samora has done.
The unusual thing about this case is that we actually have a third one. party witness.
There's an 11-year-
Actually witnessed some of the elderly who had sex.
So this is not the kind of situation he said/she said.
There was a witness who was a third party and he would say yes, these things happened.
The reason the school district is responsible, however, is that six weeks before Brittany Samora was caught, the girl of 3 grades out of 6 went in and talked to the principal and told him, hey, we thought there was something inappropriate here, we thought they were dating and we thought he was getting a treat in class.
When other children are in trouble, he will not be in trouble.
We think something has happened here.
There are rumors in the school that the teacher was pregnant by the students.
So there's a rumor that there's a sexual dating activity--
Between our clients and our wives. Zamora.
BANFIELD: So, I also want to mention it soon, because I just don't have enough time, and I want to know as much as possible about the facts, and through your allegations in the proceedings, we are also led to believe, when the class watched, we knew this product very well at CNN, which is called CNN 10, a product that provides information products for schoolchildren, and when that class was watching CNN, she and the boy will have sex behind the projector, which means she will claim that the young sixth grade student will be back in front of the projector to operate the projector, but on the contrary, the two of them will have some kind of sexual contact, actually watching CNN 10 in the classroom with the class there.
They also had sex twice after the school talent show.
So another question, you said there was a witness, a 10-year-old witness.
My understanding is, 10-year-
The old witness was actually recruited for surveillance.
It's not just a witness, is it true that this is said to be the person recruited to ensure that sex is kept private?
This is true.
He is actually 11 years old, but he is asked to be vigilant.
He knows what happened.
He had witnessed a sexual act with his own eyes.
BANFIELD: OK.
And I want to show our audience. Zamora`s --
When she appeared in front of the judge, an appearance captured by the camera.
There was a conversation between Zamora and the judge.
It is very attractive. it tells the story of the lady.
Zamora's understanding of the legal system, perhaps about how much hot water she has, or how much she doesn't understand, how much hot water she has.
It gives you the taste of this person, the taste of this sixth grade teacher.
Given the charges against her, it was fascinating to watch the game. Take a look. (

Unidentified woman: Do you just want the court to know if I should release you or impose bonds at this time?
It doesn't matter if you have nothing to say. [18:15:04]
Teacher Brittany Samora, accused of having sex with a student: I would love to go home and be released.
It will be amazing.
I don't know if there is a feeling of living in the house and I would love to get back to my husband. (END VIDEO CLIP)
Banfield: I 'd love to go home with my husband.
Eric, I like to go home with my husband.
I don't think she understands that this is what the judge asked.
She is still trapped there and owes only $25 m in bonds.
Defense lawyer Eric Weitz: it's clear that she has a lot and a lot of problems that have put her in trouble in the first place.
She probably didn't say anything, and I was surprised that no one was standing next to her at the time.
Banfield: Why is there no one standing next to her?
Weitz: there must be a process in Arizona.
I have a lot of questions about it.
BANFIELD: on the issue of the $2 million threat lawsuit, basically, take your trolley to school and fill them up, or you're going to file a lawsuit, because of this fact, you can fill it up as much as you want?
Weitz: So, in his defense, the parents have to write down a number.
The notice submitted was submitted in accordance with the Arizona regulations.
You must file such notice within 180 days of the event in which you intend to file a lawsuit, and how much you want, unless you want us to proceed with the lawsuit.
So they follow the regulations.
Banfield: but this is a bad case.
These are all bad facts.
If it is true, it is a bad fact.
WEITZ: But there's a problem with their case.
Even their experts say I can't tell you what is wrong with this young man or if he will have problems in the future. He might.
Then the question of the future is a huge one.
I'm leaving it there.
But I don't think this is the last time we heard this story. Zamora.
I would like to thank Tom Perumon and Russell richthorpe.
Eric, I will ask you if you will stay because I have more questions to ask you as well.
A New Orleans deputy was shot dead.
Don't stop beating like you usually hear.
This is at his house.
It was Father's Day.
It was his wife who was eventually accused of murder, but she said the police tried to commit suicide, and the police said, well, we have 16 good reasons to believe that what she is talking about is rubbish, stories, novels, fabrications.
I have about 13 more, but I will wait until after the break. [18:20:00](
Business break)
Banfield: he spent a whole week in the hospital before he died of injury.
I'm talking about a deputy to a sheriff who has worked on public service throughout his career.
I'm Troy Smith.
And Troy was hit in the head.
The night his wife called 911, she said he did it to himself. (

Unidentified male: operator No. 65 Jefferson Parish No. 911, where is the emergency?
Unidentified Woman: My husband was shot in the head.
Please find me now.
Male: Madam. Ma`am.
Okay mom, I need you to go find him and I need you to tell me if he's still breathing.
He's breathing, but he's barely there. -
He's bleeding everywhere.
Man: OK.
Is he conscious?
What can he say?
Woman: No, sir.
He was shot in the head. (END VIDEO CLIP)
Banfield: But now, her wife, Shante Wagner, is sitting in prison herself, and she is the wife of Troy for a few years.
Now Shantel is accused of murdering Troy.
It is reported that this is because, to a large extent, her neighbors saw her arguing with Troy, just hours before Troy was shot dead.
After Troy's own colleagues.
The staff at the sheriff's office came to a very dark conclusion that Troy could not have shot himself.
Travers Mackel is with me now, and he's a reporter for CNN affiliate WDSU.
The lawyer for Leo at Wagner Shantel Palace is with us.
Joseph Scott Morgan, certified death investigator and forensic professor at Jacksonville State University, and I live with Eric Weitz's defense lawyer.
OK, if I can start with you, list this for me.
When did Spidey's senses start to sting, maybe those words that were said on the 911 phone, the officer shot himself, maybe not what happened at that house?
Travers mackel, reporter for CNN affiliate WDSU: Well, Ashleigh, if you listen to the police and the prosecutor, basically a few hours after the initial 911 call came in, they claimed that the statement given to them by Shantel Wagner was inconsistent.
The investigation lasted about a month and then they charged her for the second timedegree murder.
According to the police and prosecutors, they said Wagner gave 16 different inconsistent statements.
One of them, who claimed that Wagner actually admitted to pulling the trigger, claimed that it was an accident.
They also said evidence. -
Police and prosecutors say the evidence collection is not over yet.
They claim the gunshot wound was on the back of Troy Smith's head, two to 3 feet away.
Therefore, they say that inconsistent statements and evidence collection do not add up.
That's why she's been charged with second-degree murder, but her defense team says that's not the case, they say former New Orleans police officer and gun expert Troy Smith, who is suffering from post-traumatic stress and has been drinking alcohol, depressed mood.
They claim that they will be able to prove that it is suicide, not murder, when the trial is held.
BANFIELD: with regard to the portion of heavy drinking, usually this indicates that you are over 0 years old. 08.
Because you can't even drink a lot and drive legally.
What is the official's actual blood alcohol level when they perform an autopsy?
Michael: It was made public at a preliminary hearing just a few days ago.
It feels more like a small trial. It was 0.
05, below the statutory limit.
According to the police and prosecutors, the critical evidence of the defense, Shantel Wagner's fingerprints were not on the guns used.
So, there's a lot of information coming out now.
The defense said it was suicide.
The prosecutor and the police said it was clear. cut homicide.
But in order to answer your question, Troy Smith's blood alcohol level is lower than the law.
BANFIELD: Well, it doesn't sound like a lot of drinking.
You know, I can't even drink lightly and stay where it's below the legal limit.
This is very charming. All right.
I want to play a little more on the 911 phone.
Again, it happens in the present.
This gives you an idea of what the person is at least acting like at the moment, whether you can read it or not, it's usually up to a jury, but you're a judge. Listen. (

Unidentified male: What institution is he with, madam?
Guess SAHNTEL Wagner: J. P.
Male: with J. P. ? WAGNER: Yes. JPSO.
Male: which group is it, Madam?
Wagner: he's in college, ma'am--sir.
May I know your phone number?
Lady, is there anyone else in the house?
Wagner: No, please--
Unidentified male: Madam, I have sent the police a while ago and they are on the way. (END VIDEO CLIP)
BANFIELD: Well, I 'd like a lawyer at Shantel Wagner, the Palace of Leo. Mr.
The inconsistent statement, Palazzo, is a big deal.
Different inconsistent statements.
Under normal circumstances, the cases of one, two, three, four, five and sixteen we hear are difficult to pass.
How did you do it?
Leo palazzo, counsel for SHANTEL wagners: what they say is absolutely ridiculous in terms of the inconsistency of these statements.
What you are talking about is the first statement of our efforts, starting at 911, which is consistent and what she said from day one, he committed suicide.
The second statement was made at the scene by the official.
Still, it was not recorded.
The woman is said to have just seen her husband shoot himself and bleed to death.
He wrote in his notes that when the shooting occurred, she said she was outside.
This was a woman who was shocked at the time.
One of her neighbors testified on Monday that she came out and she said that I had blood all over me.
She has no blood on her body.
This is a woman who has been shocked since the incident.
She is now in solitary confinement for 23 hours.
She has an hour off to eat and take a bath.
BANFIELD: OK.
She was still shocked.
Banfield: Well, I have to say, sir.
If you are a high risk prisoner, you may be held in solitary confinement.
This does not account for the facts of the case.
I asked you this.
At the funeral, Wagner said, a neighbor said it was an accident that my husband did not commit suicide.
This is completely different from what she said to the police, the first statement is that the gun is aimed at his head, and the other statement is that the gun is a few inches away from his head.
These are inconsistent for the police and very inconsistent for the neighbors.
How did you go?
They are not really inconsistent.
You must be aware of what you said.
What you're talking about is a woman saying over and over again that he went in and he pulled the gun out and put it on his head to shoot.
As for the inconsistency, is his head correct, 6 inch, 12 inch, the statement has said over and over again that he shot himself in the head.
This is said over and over again.
There is no dispute.
BANFIELD: Mr.
Palazzo, don't you also argue that the forensic doctor indicated that the shot was in the direction of the back head, did the police think that the shot was in the direction of the temple?
I don't think a forensic doctor will lie.
I'm a little confused. PALAZZO: No. No.
You actually make a mess of things, you make a mess of things.
The evidence is clear, C. T. scan is clear.
This is right above the temple shooting, we have actually had the coroner testify, she said it was right above the temple shooting, right to left, from front to back, from front to back.
This is a typical suicide shot.
BANFIELD: OK.
So Joseph Scott Morgan, join us.
You read the report, the text report, not the actual CT scan.
There is no way we can do this.
But what did it tell you?
Certified death investigator Joseph Scott Morgan: Well, it told me the CT report.
The radiologist did not actually determine the entry point.
She is talking about displacement, bone fragments and metal fragments.
If I can back it up a little.
In a statement made in court, the coroner, the pathologist, they were allowed to say, and they never used the word Temple.
They're talking about the top bone.
It goes right above and later on the right ear, up through the vertex.
So there's an injury above your ear, okay, that's moving up along the upward trajectory.
It left the top of the head.
So, you know, at the end of the day, what we really need to know is what the coroner is going to say, because in this particular case, they don't say anything about the scope of the fire. (CROSSTALK)BANFIELD: OK.
I can hear your dog barking in the background.
I think that's yours. I`m not sure (Inaudible).
I just want to make sure that our audience knows that this is just something in the background and has nothing to do with the story itself.
There is another question.
I just wanted to make sure. (CROSSTALK)
Morgan: I 'd like to follow up on this review because. (CROSSTALK)
BANFIELD: I'm running out of time and still have to deal with conflict of interest issues. (CROSSTALK)
BANFIELD: To be honest, I wish I had more time, but I gave you more than everyone else in this section.
Eric, soon, did the police investigate whether there was a conflict of interest in their own case?
Defense lawyer Eric Weitz: who else will investigate?
I mean, I think that in this case it would be both worlds, because if it was their own person who was murdered or killed, you will think that they may follow every policy and procedure as they know they will be subject to greater scrutiny.
Banfield: that might be--
You know the area is also well suited for appeal.
I'm sorry, sir. Palazzo.
I wish I had more time but there were four guests and some forensic material to run (Inaudible).
We will have to visit you again at this point and hope you will come back and visit us again.
I 'd love to go.
BANFIELD: Great. thank you very much.
Leo Pazzo, thank you, Joseph Scott Morgan, as always, Eric, you'll stay for the next block if you can.
Tonight, I want to tell you a story about the great rapids.
There is now a Michigan couple in prison who are facing murder charges because their 10-month-old daughter is starving to death.
When the judge told them of their highest punishment, the father could not believe what he had heard. Take a look. (

Unidentified women: You are all charged with what they call felony murder, and abuse or attempted child abuse at level 1. (Inaudible)
You murdered (Inaudible)
This is a charge known as a felony murder.
Life without parole. (END VIDEO CLIP)
Banfield: it's dad's reaction, it's mom's reaction.
Prosecutors say Seth Welch and Tatiana fosari did not seek any medical help for the little girl, in part for religious reasons.
The autopsy found that the child died of malnutrition and dehydration in the United States.
That is all, according to the court's documents.
Parents admitted to the police that at least a month before their daughter died, they were aware of her thin appearance and low weight.
They are all now charged with murder and, as you have heard from the judge, child abuse.
This is quite a reaction.
When Brad and Angelina decided to accuse him of being a dead father, her divorce was going through a pretty bad turn.
The days of Brangelina's rule of the red carpet have passed, and the question now is how long this open fight will last. (

Banfield: that's probably what's happening now when Angelina launches ammunition to her husband.
But it could also explode on her face as Angelina has just accused Brad of not paying what she calls meaningful child support.
Meaningful child support since they separated.
It's not true what he said.
Now she says she wants him to come up with the money so they can finally get divorced.
But Brad's camp says it's just another punch in the painful custody battle, perhaps the worst, because they don't just say Brad is paid in the money Department.
They said Angelina was trying to drag his name into the mud and escalate the battle.
I want to bring my group in.
Christina Garibaldi is an American weekly journalist and Randy Kessler's family law lawyer is with me as well.
He is the author of divorce: protecting yourself, your children and your future.
Last Monday, he happened to mediate the marriage of a wealthy athlete in Los Angeles (Inaudible)county.
Okay, first of all, Christina, to you and the story (Inaudible)
What's going on?
S. Weekly reporter christina garibaldi: A lot has happened.
There's a lot to unlock here.
Like you said, Angelina says Brad has been running away from child support since he broke up in 2016.
So she said it's been almost two years since he offered any money to his children.
We heard it. (CROSSTALK)
She said nothing.
What she said makes sense. (CROSSTALK)
Banfield: everyone can judge.
There's no dollar amount, is there? (CROSSTALK)GARIBALDI: No.
He said he lent her $8 million to get their children near him in California.
In addition, there is another $1.
We also hear about the safety of 3 million of child benefits including his children.
So he's been giving some meaningful money.
Now she said, like you said, she just wanted to end it so you know to bow for this marriage and you know to make them all together
Good parents together
He's saying it's just a thin-
The veil tried to manipulate the media and dragged his name into the mud.
Banfield: I think his camp has released this strange thing, that is, they sat down.
Closed down a few weeks ago.
Yes, no, they do. (CROSSTALK)
Yes.
Banfield: no such thing was mentioned at the meeting.
GARIBALDI: No.
This is the first time Angelina has said anything. (CROSSTALK)BANFIELD: OK.
So when you get together, have kids, come to these law firms to meet.
Normally you will collect everything. (CROSSTALK)
Banfield: you don't go to the law firm at that time.
Why then--
At the meeting a few weeks ago, all these things were not even whispered?
Garibaldi: It seems that as early as June, they went to a lawyer again because they drafted a different interim custody agreement.
She always wanted to see the children go to London while filming Maleficent II.
I don't think he is.
No, I want to be with my kids too.
So the judge is good for Brad and it is harmful to say that children don't have time to be with their father. (CROSSTALK)
BANFIELD: She was also told not to say anything. (CROSSTALK)
BANFIELD: I'm trying to remember what the actual order is.
You're not allowed--
You must tell the children that it is safe for them to be with their father and that it is essential to establish a healthy relationship with both parents.
This is a fairly tough judgment.
For Randy Kessler, I don't know what's going on between them.
I don't know what agreement they have.
I don't know how much it cost to go back and forth.
But what does Los Angeles look like in terms of child support and child support?
Randy Kessler, a family law lawyer: Well, it's Los Angeles. la-land.
This is the kind of case that all divorce lawyers in the country are talking about because there are no rules.
There is no specification. (Inaudible)
Since this is a small part of the US case law, we hope that this case will provide guidance.
There's something unique about California, like once they start raising their children.
They then Award it retroactively, saying this is what you should pay. [18:44:54]
Maybe she was angry with the judge's order.
Maybe she wants to make sure, you know, that he gets information that two people can play in this game.
When you submit such a file, a variety of subtle messages are sent.
We don't know what happened.
But it looks interesting and charming.
Hopefully from now on, when we come across a situation like this, we say, remember what happened to Brad and Angelina.
Don't let it go there.
Solve your case.
A precedent may have been set. And you know --
Look, everyone should take a deep breath because sometimes the media is part of this battle when it's a celebrity.
If they were just gentlemen, the same thing wouldn't have happened. And Mrs. Smith.
I'm sorry, this is incredible.
Christina Garibaldi and Randy Kessler, thank you, thank you very much.
We will continue to focus.
I hope the kids are okay.
They all look cute.
How far will you go to try to convince you to get rid of the arrest on the side of the road?
Will you brag about your achievements?
Can you mention a family member in the army?
Can you tell the police how clean you are?
It is alleged that this is what the young lady did when she was stopped for drunk driving, and she told the police that she was a very clean, thoroughbred white girl.
When it all goes deep into the hearts of the people, we will arrange all of these details to make you truly meaningful and follow. (
Business break)[18:50:00]
BANFIELD: Before I start my next story, I think it is very clear that driving under this influence is never possible.
No one defended it.
There is no reason for this.
But it seems to be 32-year-
Old Lauren carcatshaw, who allegedly tried to do so when he was stopped last Friday, told officials that she had gone out for some early celebrations of her birthday.
Bluffton Police quickly identified her as a drunk driver and took her away.
That's when things happen, because once chshaw gets to the police station, she lists a lot of reasons why she shouldn't be arrested.
She also did it on the spot.
I'm going to play some sound for you from the pitch and you 'd better sit down for that. (

Unidentified woman: a few glasses.
I mean, I'm celebrating my birthday.
I have never been arrested.
Can't you see it in your system?
Can't you see that I graduated from a really good university?
I graduated in 3 points.
In my high school.
I got a scholarship from the University.
That's my birthday present.
Please, I'm one.
American cheerleaders(END VIDEO CLIP)BANFIELD: (Inaudible)
She said her partner was a police officer, and she joined a sorority, honor list.
But it was actually her next assertion that made her headlines.
She said she told the police that she was a white girl with clean, pure stallion, a white, clean girl.
When the officer asked her exactly what you meant, she told him, quote, you should know what that meant, and then added, quote, you are a cop.
According to the person who entered the room, you should know.
On the record
Carshaw blew it.
Police also found marijuana in her car and he is now facing a laundry list.
Now with me is retired police lieutenant Randy Sutton, Randy, except to be ruthlessly ridiculed on national television, which doesn't help her case, she goes there and says
Retired police Lieutenant Randy Sutton: So I don't think it will help, especially, you know everything is public now.
The truth is, people say incredible things, A, when they get drunk, B, when they try to get out of the ticket.
I see over and over again that the way people behave will shock you.
The fact that she is.
She's really high in alcohol.
I can imagine she woke up the next day with a lot more than a hangover.
Yes.
Well, as we said, the third place on national television is lower.
Thank you, Randy. thank you.
By the way, you're white.
There is no doubt about this.
But if this really happens, your record is not clean.
Have you all heard this and have been partying before the cows go home?
OK, what happens if you rush into their home and you are not invited, the police are on your tail?
One more thing to follow. (
Business break)[18:55:00]
Banfield: One more thing for you tonight.
When the police released the canine, we had seen a lot of police chasing, right?
I want you to see what happens when the suspect runs into a ranch full of cattle. (

Unidentified male: in fact, a large group of cows are following her for good visual results.
Looks like they might attack her. (END VIDEO CLIP)[19:00:11]

I don't know what will happen to her hiding place. I`m awesome.
The next hour of crime and justice is about to begin. (Start Video)
You know her name.
Unidentified male: Molly tibez.
Unidentified male: Molly tibez.
Unidentified male: Molly tibez.
Unidentified female: college girls are missing after running.
We went on a field trip. she didn't come.
Tonight, Molly's father talked to us about the suffering of the family.
Unidentified male: I don't think anyone is starting to hurt Molly.
Unidentified woman: a new photo of Molly appeared the day before she disappeared.
Unidentified men: someone knows exactly what's going on and they just don't stand up.
New theories began to emerge.
Unidentified male: does not mean hurting Morley, but does not know how to end the situation.
Unidentified women: What do local pig farmers know about where Molly might end up?
Unidentified male: Asked for hours.
Unidentified Woman: Why didn't he take the lie detector test?
We are wasting our time. I`m done.
She told the police he committed suicide.
My husband just shot himself in the head.
A police officer may have just suffered from depression.
Unidentified male: He is drinking.
He is taking medicine.
He posted these suicidal, dark posts.
But did he really kill himself?
Unidentified male: broken.
Or did he just have a deadly wife?
I think there is a clear conflict.
You can see it.
Unidentified Woman: Why did investigators say her story doesn't add up.
Woman: Are you satisfied?
Man: not for years.
Unidentified women: Maybe they are not acting.
Brad and Angelina broke up even worse.
Man: We have a few questions ourselves.
Are you okay, baby?
But how can the two most beautiful people in Hollywood make such an ugly mess?
Man: Do you think there is a happy ending to this story?
Unnamed woman: happy ending is an unfinished story. (END VIDEOTAPE)
Good evening everyone.
I'm Ashley Banfield.
Welcome to the second hour of crime and justice.
Tonight, the search for Molly tibates continues, and the search for people who may or may not know where she is continues.
Because Mollie was missing in a small town with only 1,500 people, she was walking her dog.
Sitting next to her boyfriend.
But the boyfriend is not in town, far away from here.
Therefore, it is reported that her colleagues at the local summer camp sounded the alarm when Molly did not go to work the next morning.
It was today three weeks ago.
Tonight, Moley may be anywhere, and some people are worried about her being kidnapped, and her father is making headlines because of his own theory about who his daughter might be. (

ROB tibbts, father of MOLLIE tibbts: I don't think anyone is starting to hurt Mollie, which doesn't mean hurting Mollie, but I don't know how to end it.
This is a small town.
We're all from Iowa.
We all know what the town looks like.
Someone knows what's going on.
And they just --(END VIDEO CLIP)
No answer for three weeks.
Moley's family and Moley's friends are eager to get any information, just like local pig farmers, who said he talked to investigators about his--
About her disappearance.
Although now he refuses to take the lie detector test.
Insider reporter Steven Fabian is with me now and has actually just returned from Brooklyn, Iowa.
I'm with defense lawyer Eric Weltz.
Also, Rob tibbts, Mollie tibbts father and retired police lieutenant Randy Sutton were with me on the phone.
You just got back from Iowa.
What did you learn?
Insider reporter Steven Fabian: anyone is talking about it in Brooklyn, Iowa, where there are some signs that people have Morley TI in their cars, businesses and diners
Everywhere you look is Molly's face.
Everyone is trying to plug in.
As you mentioned, there are 60 law enforcement tips per day.
It's been three weeks.
This is a lot of tips added.
Of course, they think everyone is suitable for the investigation.
Reward $300,000.
BANFIELD: it's growing, isn't it?
FABIAN: it is developing by leaps and bounds.
BANFIELD: constantly.
15 hundred people, they got such a big reward? FABIAN: Yes.
This is for Molly's safe return.
Of course, we hope that this family will end in some form.
Let me ask you this question.
I haven't been to Brooklyn, Iowa. FABIAN: Yes.
BANFIELD: but as a small town where I work, they don't usually have a lot of resources, they don't have a huge police force, there is also not much experience in very complex, tricky cases, forensic, missing persons, that kind of thing.
Is that the case here? Or did the FBI help them a lot? [19:05:04]FABIAN: Yes. Well, look.
The FBI stepped in here.
We know you mentioned Wayne Cheney, a pig farmer of that time.
They have asked him many times, five times.
Why are they asking him?
We don't know.
What is his story?
What's his connection?
Who knows now?
Is the place where he lives?
Did he find the red shirt at his place?
We don't know, because the investigators kept their mouths shut.
Banfield: so back it up.
But there will be a reason.
BANFIELD: Yes.
Back up for those who may not know those little nuggets and red shirts you just fit, explain the connection between the two
This is a contradiction with the reason why they might come to his property and say we want to talk about it.
FABIAN: Right.
According to her friends, family, and habitual runners, Molly is apparently missing with her phone and body-fitting clothes she has been wearing.
Of course, accessories that can't track your whereabouts using GPS technology.
Now, a red shirt is found in the Brooklyn area.
Molly did wear a red shirt at her summer camp.
Whether this red shirt really belongs to Molly has not been said yet.
But there must be a reason why investigators continue to return to the person's property.
The red shirt was found near his residence, near his field, near his home, or is the fitness tracker appropriate, did it ping near his residence? That's why investigators are attracted?
Banfield: then, I will ask more questions in a moment.
But when we look at the farm, it is vital to say at this point that Wayne Cheney, the pig farmer, is not a suspect.
He was not listed as a suspect.
He was not charged.
But like you said, Steven, he's been talking to the police, and a reporter has taken the microphone to his place.
I want to play this Q & A game so you can get to know how he feels and how he reacts to this intense spotlight. Take a look. (
Start Video Editing)
Unidentified male: How is your situation here and how do they handle everything?
Wayne Cheney, who was questioned by the authorities: Oh, I don't know.
We are wasting our time. I`m done.
You said the FBI took you to the fire station, right?
Cheney: It's not the FBI.
I don't know who the two of them are, but they took me to the fire station on Tuesday.
Man: OK.
They asked--
Cheney: they asked me for hours.
Man: What kind of problem?
Cheney: I don't remember anything they asked me.
This is a waste of time, I think. I don`t know. I`m done. I`m done. (END VIDEO CLIP)
Banfield: Fabian, you also have a chance to talk to this person.
What did you ask him? FABIAN: Yes.
We saw Wayne Cheney cut the grass on a loan mower.
He has a lot of property there.
We wait for him to cut the grass and then we ask him, Hey, can we ask you a few questions?
Do you have anything to do with Molly tibez's disappearance?
He said no, I'm not very clear.
Then I said why did you refuse to take the lie detector test?
He did not answer me.
He went straight into his house and slipped the door.
So he was upset.
If he has nothing, listen to me. with this.
It was a terrible situation for him.
Absolutely.
To be frank, I will repeat it.
The police did not indicate at all that he was a suspect in this regard.
They are looking for a lot of clues.
In fact, to do that, let me bring in Molly's dad, Rob tibeitz.
Rob, can you hear me? TIBBETTS (on the phone): Yes, I can.
Thank you for inviting me.
Banfield: Thank you for joining us.
You know, first of all, I can say I'm sorry we met in this case.
I just can't imagine, you know, what it's like to be on your side right now.
Let's eat the meat.
What did the police tell you?
Well, the police are talking to us every day.
This is a large complex law enforcement team composed of county, state and FBI.
They did not share the information about the survey for two reasons.
First, they don't want to put the search at risk or put Mollie in danger.
But what they're telling us is that in terms of how to explain what we see and hear about what they're doing, more guidance, not reading any thread too much, like this farmer in the Deep River.
They also actively tracked dozens of leads, but they were not part of the public record and the media did not follow them.
Banfield: are you upset that Wayne Cheney, a pig farmer, won't accept a lie detector?
Do you think there is no difference between him and the leader anywhere else?
I don't think he's any different from any other leader.
The authorities have been explaining to us--
I think you have a former FBI agent there.
It's a process that takes some time, and it's comprehensive, and they have to exclude as much information as possible before they start focusing on narrower bandwidth.
You know, I remember reporting the disappearance of Elizabeth Smart.
I hope a case like this can bring you a lot of hope.
Nine months later, Elizabeth Smart appeared.
She is safe and healthy and has a good life.
I remember a lot of organizations, you know, Mr. tutorship. and Mrs.
Smart carefully posted photos and moments to keep her front and center.
Keep her image positive and central.
For this I can only assume that this is why we have this new Molly video.
I think it started the day before she went missing.
I just wanted to describe this video as a very happy look for your daughter.
Good luck and have a good time.
I think this is probably the laughter we can hear in the camp and in the background.
I want to play for a while so people know who we are looking for and who we are looking. (
Video clip playback)[19:11:11]
Banfield: Rob, as I said, these are pictures of the day before Molly went missing on the run.
Everything looks great in her life.
She seemed to enjoy the day.
There seems to be nothing wrong at work.
There seems to be no skew in her life.
Right?
Absolutely.
She is spending the summer of her life.
She was at my wedding in California.
She's my best man.
She has a new passport.
She plans to go to the dominican Republic to buy her first international stamp.
She rented an apartment for the school.
She's going back in her sophomore year.
She fell in love with Dalton.
The more time I spend with him, the more I understand why Molly loves him so much.
So, yes, she's just enjoying the time of her life.
Banfield: Rob, do you know the clothes that fit her?
Is it one of the newer models, Fit Bit?
Because, as far as we know, newer Fit bits actually have GPS positioning, they may provide a very rich amount of information for the police to be able to digitally track her last moments.
I don't know.
Unfortunately, I may be the last person to be technically smart enough to answer such questions.
BANFIELD: You know if she has a cell phone with her while running, because as long as there is a cell phone nearby, some old accessories are OK, project this digital information into the cloud, is this something that can obviously be tracked?
I don't know the technical impact.
But I know that when Molly runs, she listens to music with her mobile phone.
So she probably had this experience with her.
No one found the phone, right?
We don't know where her phone is or am I not correct?
TIBBETTS: We don't know where her phone or Fit Bit is.
So these two parts of her digital footprint are absolutely critical.
So these devices and her computer, as well as social media platforms that are mainly Snap Chat, Instagram and Facebook ---
I don't know if these companies are not, but I hope and pray that these technology companies will comply with and cooperate with the law enforcement team in a passionate and comprehensive manner.
We haven't seen this in the past.
So I do worry about it.
So the extent to which we can use the media to urge these companies to comply ---
Because Molly's life is balanced.
We need information from them.
BANFIELD: Do you know they don't follow the rules? Or are you just worried ---TIBBETTS: No.
I just said, I don't know if they are.
However, we have seen in the past that they are reluctant to comply due to privacy issues.
Fully understood.
TIBBETTS: I understand that the authorities had to initially issue warrants to these companies for them to comply.
So this is not--
This does not mean compliance to me.
So I hope they are.
We just need to remind them of the urgency of participation.
Banfield: Let me use Randy Sutton as a retired police lieutenant if I can ---
I can't imagine the importance of this appropriate information, but can we also assume what the police are doing about it now?
What kind of technology do they keep near the vest?
Retired police Lieutenant Randy Sutton: they are very, very close to the vest ---
They got all kinds of information, forensic information.
They are looking for DNA, technical information.
They are searching on social media. And then old-
The old-fashioned shoe leather police work where they knock on the door, talk to people, and even if it's just the bad guys, someone knows something.
There's a guy out there--
I pray that she is still under the custody of this person and that he will listen to her father's request and end it all by sending her home. [19:15:43]
Banfield: Eric, seriously, five seconds on it.
It's so critical to say this pig farmer is not a suspect.
Eric Weltz, defense lawyer: Yes.
He's not a suspect, but his behavior is a bit suspicious.
BANFIELD: More questions may be raised.
So, that's the key.
Thank you to all my guests.
I really appreciate it.
In fact, I want to ask if Randy and Eric can stay.
On Father's Day, the deputy mayor of New Orleans was shot dead at his home, and now his wife is charged with murder, but she said he tried to kill himself. That`s next. (
Business break)[19:21:04]
Banfield: he spent a whole week in the hospital before he died of injury.
I'm talking about a deputy to a sheriff who has worked on public service throughout his career.
I'm Troy Smith.
And Troy was hit in the head.
The night his wife hit 911, she said he was playing by himself. (Start Video)
Male: Jefferson Parish 911Operator 65.
Where is the emergency?
My husband just shot himself in the head.
I need someone now.
Male: Madam?
Woman: No!
Male: Madam?
Woman: Yes, sir.
M: OK, ma'am. I need you to find him.
I need you to tell me if he's still breathing.
Woman: Sir, he's breathing, but he's barely breathing.
He's bleeding everywhere.
Man: OK.
Is he conscious?
What can he say?
Woman: No, sir.
He was shot in the head. (END VIDEOTAPE)
Banfield: But now, her wife, chantar Wagner, is sitting in prison herself, the wife of Troy for several years.
Now Chantal is charged with the murder of Troy.
It is reported that this is because, to a large extent, a neighbor saw her arguing with Troy, just hours before Troy was shot dead.
Also, after Troy's own colleagues in the sheriff's office came to a very dark conclusion, it was impossible for Troy to shoot himself.
Now with me, traverse Mackel is a reporter for CNN member WDSU.
Lawyer Leo Palazzo of Chantal Wagner is with us, certified death investigator and forensic professor Joseph Scott Morgan from Jacksonville State University is with me, and defense lawyer Eric Weltz is with me tooAll right.
Traverse, if I can get you started, list this for me.
When did Spidey's senses start to sting, maybe those words that were said on the 911 phone, the officer shot himself, maybe not what happened at that house?
Travers mackle from WDSU, CNN affiliate: Well, Ashleigh, if you listen to the police and the prosecutor, basically a few hours after the initial 911 call rang, they claim that chantar Wagner gave them an inconsistent statement, that the investigation lasted about a month, and then they charged her for the second time. degree murder.
According to the police and prosecutors, they said Wagner gave 16 different inconsistent statements, one of which was that they claimed Wagner actually admitted that he had pulled the trigger.
They claimed it was an accident.
In addition, they said forensic doctors, police officers and prosecutors said evidence collection was not included.
They claim that the gunshot wound also hit the back of Troy Smith's head about two to 3 feet away.
Therefore, they say that inconsistent statements and evidence collection do not add up.
That's why she was charged second. degree murder.
But her defense team says this is not the case.
They said former New Orleans police and gun expert Troy Smith was suffering from post-traumatic stress and I drank a lot of wine and was in a low mood and they claimed that when the trial, they will be able to prove that it was suicide, not murder. --Ashleigh.
BANFIELD: So with regard to the portion of heavy drinking, it usually indicates that you weigh more than 08 kilograms because you can't even drink a lot and drive legally.
What is the official's actual blood alcohol level when they perform an autopsy?
Michael: It was released at a preliminary hearing a few days ago and feels more like a small trial. It was .
05 below the statutory limit.
According to the police and prosecutors, the defense's key evidence is that the fingerprints of Chantal Wagner are not on the guns used.
So, there's a lot of information coming out now.
The defense said it was suicide.
The prosecutor and the police said it was clear. cut homicide.
To answer your question, the blood alcohol level of Troy Smith is lower than what is prescribed by law. [19:25:14]
BANFIELD: it doesn't sound like a lot of drinking.
You know, I can't even drive lightly and stay somewhere below the legal limit.
This is charming. All right.
I want to play a little more on the 911 phone.
Again, it happens at the moment, which gives you the instructions of this man, at least, what his act is like at the moment, and whether or not you can read it is up to the jury to decide.
You are the judge. Listen. (

Unidentified male: What institution is he with, madam?
He is with JP.

Woman: Yes, JPSO.
Male: which group is it, Madam?
Unidentified female: In college, Madam-sir.
May I know your phone number?
Is there anyone else in the house?
Woman: No. Please.
Unidentified male: I sent the police a while ago.
They are on the road. (END VIDEO CLIP)
So I would like to ask Leo Pazzo, a lawyer for chantar Wagner. Mr.
Palace, the inconsistent statement is a big deal, 16 different inconsistent statements.
Usually, we hear one, two, three, four, five cases.
16 is a very sad number.
How did you do it?
Suspect lawyer leo palazzo: what they say is absolutely ridiculous in terms of the inconsistency of these statements.
You're talking about them--
The first statement we heard started at 911, which is consistent with what she said from the first day, and he committed suicide.
The second statement was made at the scene by the official.
Again, it was not recorded.
It is said that the woman had just seen her husband shoot himself and bleed to death, and he wrote in his notes that she said he was ---
She was outside the shooting.
This was a woman who was shocked at the time.
One of her neighbors testified on Monday that ---
She came out and said I had blood all over me.
She has no blood on her body.
This is a woman who has been shocked since the incident.
She is now in solitary confinement for 23 hours.
She has an hour off to eat and take a bath.
BANFIELD: OK.
This is not unusual.
It's not unusual, you know.
I have to say, sir.
That's it, Palazzo.
If you are a high school student, you will be put in prison.
Prisoners at risk, you may be held in solitary confinement.
This is inconsistent with the facts of the case.
I asked you this. A neighbor --
A neighbor said at the funeral that Wagner said my husband did not commit suicide.
This is an accident.
This is completely different from what she said to the police, and her first statement was that the gun was on his head.
The other is that the gun is only a few inches away from his head.
These are inconsistent for the police and very inconsistent for the neighbors.
How did you go?
Palace: It's really inconsistent.
You must be aware of what you said.
What you're talking about is a woman saying over and over again, he went in, pulled out the gun and fired it on his head.
As for any inconsistency with this, is his head correct, 6 inch, 12 inch, stating over and over again that he shot himself in the head.
This has been said over and over again and there is no dispute.
Banfield: neither do you-Mr.
Palazzo, don't you think the forensic doctor thinks the shooting is in the direction of the back of the head, and the police think it's in the direction of the temple?
I don't think a forensic doctor will lie.
I'm a little confused.
Palace: No, no, no.
